Midnyte

Terms of Use

Midnyte is a personal project run by an individual (“we”, “the operator”), not a company. It's a Telegram bot and Mini App where you chat with fictional AI characters. By using Midnyte you agree to these terms. If you don't agree, please don't use it.

1. Adults only

Midnyte is only for people aged 18 or older, or older if the age of majority where you live is higher. Conversations and generated photos can be sexually explicit. You must confirm your age before using it. If we learn that a user is under 18, we close their access and delete their data.

2. Fictional AI, not real people

Every character is fictional and played by an AI. They aren't real people and don't have feelings. They can make mistakes or say things that aren't true. Nothing they say is professional advice (medical, legal, financial or otherwise). Photos and clips are AI-generated images of fictional characters.

3. What you may not do

• Ask for, or try to create, any content involving minors or anyone who appears to be under 18, in any form.
• Use Midnyte to depict real, identifiable people sexually, or to harass, threaten or harm anyone.
• Ask for content that is illegal where you live, or that involves non-consent presented as real, bestiality or extreme violence.
• Abuse the service: automated access, scraping, attempts to break or bypass limits or payments, or reselling access.

We may refuse requests, remove content, and suspend or close access if these rules are broken.

4. Gems, gifts and Premium

• Gems, gifts and Premium passes are bought with Telegram Stars through Telegram. They are virtual items for use in Midnyte only: they have no cash value and can't be transferred, exchanged or withdrawn.
• Gems are spent when you receive things that cost Gems, such as generated photos and clips. Gifts are fictional digital items. Premium passes are one-time passes for a set period, with no automatic renewal.
• Prices are shown before you buy. We may change prices and what items include, but not for items you've already bought.
• Gems and items may be lost if your access is closed for breaking these terms, or if Midnyte shuts down. We'll give notice in the bot where we reasonably can.

5. Refunds and help

For any problem with a purchase, send /paysupport to the bot. We review refund requests individually, for example when a purchase failed or a photo you paid for didn't arrive. Refunds are made in Telegram Stars through Telegram. Refunded Gems are removed from your balance.

6. Your content

You are responsible for what you send. We don't claim ownership of your messages. You allow us to process them to run Midnyte (see the Privacy Policy). Generated photos are provided for your personal, private use.

7. Availability and changes

Midnyte is provided “as is”, as a personal project. It may be unavailable at times, change, or be discontinued, and features or characters may change without notice. We may update these terms; the date above shows the latest version, and continuing to use Midnyte means you accept the update.

8. Limitation of liability

As far as the law allows, the operator isn't liable for indirect or consequential losses arising from your use of Midnyte. Our total liability for anything else is limited to what you paid us in the 3 months before the claim. Nothing here limits rights you have that can't legally be limited.

9. Telegram

Midnyte runs on Telegram, and Telegram's own Terms of Service and Stars Terms also apply. Telegram isn't responsible for Midnyte.
